주식회사 메테오바이오텍에서 외자물품 구매를 위하여 다음과 같이 입찰에 부치고자 공고합니다.

Meteobiotech Co., Ltd. hereby invites bids for the purchase of foreign-sourced goods as follows.

○ 본 공고문은 입찰의 핵심사항을 안내하기 위한 문서이며, 세부 절차·유의사항 및 제출양식은 「외자구매 입찰유의서 및 양식」에 따릅니다.

This Bid Invitation provides the key terms of the bid. Detailed procedures, instructions, and submission forms shall be governed by the General Instructions to Bidders and Forms.

○ 본 공고문 및 입찰 관련 문서는 이해를 돕기 위하여 국문과 영문을 병기하였으며, 해석상 차이가 있는 경우 국문이 우선합니다.

This notice and related bid documents are presented in Korean and English for convenience. In case of any discrepancy, the Korean version shall prevail.

*. 입찰에 부치는 사항
*. Matters Subject to Bid

○ 본 공고의 모든 일시는 대한민국 표준시(KST)를 기준으로 합니다.

All dates and times in this notice are based on Korea Standard Time (KST).

○ 입찰등록서류는 마감일시까지 지정 장소에 도착하여야 하며, 장소·접수시간 착오 또는 우편 지연 등으로 마감시간까지 도착하지 못한 책임은 입찰자에게 있습니다.

Bid registration documents must arrive at the designated place by the deadline. The bidder shall be responsible for any failure to arrive by the deadline due to misunderstanding of the place or time, postal delay, or any other reason.

*. 입찰설명서 및 적용 기준
*. Bid Documents and Applicable Standards

○ 입찰에 참가하고자 하는 자는 입찰공고문, 구매규격서, 외자구매 입찰유의서 및 양식, 계약조건 등 입찰설명서를 반드시 열람·숙지한 후 입찰에 참가하여야 합니다.

A bidder must review and fully understand the bid documents, including this Bid Invitation, purchase specifications, General Instructions to Bidders and Forms, and contract terms, before participating in the bid.

○ 본 입찰 및 계약은 「국가를 당사자로 하는 계약에 관한 법률」 및 같은 법 시행령·시행규칙, 관련 계약예규(외자계약 일반조건 등)를 준용하며, 본 공고 및 발주기관이 정한 조건에 따라 진행하고, 공고문에 명시되지 않은 사항은 입찰유의서, 계약조건 및 발주기관이 정하는 바에 따릅니다.

This bid and contract shall apply mutatis mutandis the Act on Contracts to Which the State Is a Party and its Enforcement Decree and Rules, and related contract regulations (including the General Conditions of the Foreign Contract), and shall be conducted in accordance with this notice and the conditions set by the Ordering Company. Matters not specified herein shall be governed by the General Instructions to Bidders, contract terms, and the Ordering Company's decision.

○ 본 입찰의 공고는 국가종합전자조달시스템(나라장터)에 게시하며, 입찰서 제출 및 개찰은 전자입찰에 의하지 아니하고 직접 제출 또는 국제우편 방식으로 진행합니다. 세부 제출방법은 제*항에 따릅니다.

This bid is announced through the Korea ON-line E-Procurement System (KONEPS / 나라장터); the submission of bids and bid opening shall be conducted by direct submission or international mail, not by electronic bidding. Detailed submission methods are set out in Section *.

○ 입찰자는 해외공급자 또는 제조자에게 납품기한, 인도조건, 대금지급조건, 설치·시운전, 하자보증 등 주요 계약조건을 사전에 확인하여야 하며, 미확인으로 인한 불이익은 입찰자 및 해당 공급자에게 있습니다.

The bidder must confirm in advance with the overseas supplier or manufacturer key contract terms including delivery period, delivery terms, payment terms, installation and trial operation, and warranty. Any disadvantage resulting from failure to confirm such terms shall be borne by the bidder and the relevant supplier.

*. 계약방법, 입찰방법 및 낙찰자 결정방법
*. Contract Method, Bidding Method, and Award Criteria

가. 계약방법: 일반경쟁입찰
A. Contract method: Open competitive bidding

나. 입찰방법: *단계 경쟁입찰(규격입찰과 가격입찰 분리)
B. Bidding method: Two-stage competitive bidding (technical bid and price bid submitted separately)

다. 입찰자는 입찰등록 마감일시까지 규격입찰서류와 가격입찰서류를 동시에 제출하여야 하며, 가격입찰서류는 별도 봉투에 밀봉하여 제출하여야 합니다.
C. Bidders shall submit both technical bid documents and price bid documents by the bid registration deadline. The price bid documents shall be submitted in a separately sealed envelope.

라. 발주기관은 먼저 규격입찰서류를 검토하여 규격 적격 여부를 판단하고, 규격 적격자로 판정된 입찰자의 가격입찰서류에 한하여 개봉·평가합니다.

D. The Ordering Company shall first review the technical bid documents to determine technical qualification and shall open and evaluate only the price bid documents of bidders determined to be technically qualified.

마. 규격 부적격자로 판정된 입찰자의 가격입찰서류는 개봉하지 아니하며, 해당 입찰자는 낙찰자 결정 대상에서 제외됩니다.

E. The price bid documents of bidders determined to be technically non-qualified shall not be opened, and such bidders shall be excluded from award consideration.

바. 낙찰자 결정방법: 규격 적격자로 판정된 자 중 추정가격 이하의 최저가격을 제출한 업체를 낙찰예정자로 선정합니다.

F. Award criteria: Among the bidders determined to be technically qualified, the bidder submitting the lowest price at or below the estimated price shall be selected as the prospective successful bidder.

사. 동일가격 입찰자가 *인 이상인 경우에는 추첨, 재입찰 또는 발주기관의 내부평가기준 등 입찰유의서에서 정한 방식에 따라 낙찰자를 결정합니다.
G. If two or more bidders submit the same price, the successful bidder shall be determined by lot drawing, re-bidding, the Ordering Company's internal evaluation criteria, or another method specified in the General Instructions to Bidders.

아. 유효한 입찰자가 *인인 경우 발주기관은 구매 필요성, 입찰의 성격 및 내부 구매기준을 고려하여 유찰, 재공고, 재입찰 또는 후속 계약절차 진행 여부를 결정할 수 있습니다.
H. If there is only one valid bidder, the Ordering Company may determine whether to declare the bid unsuccessful, re-announce the bid, conduct a re-bid, or proceed with subsequent contract procedures, considering procurement needs, the nature of the bid, and internal procurement standards

*. 입찰참가자격
*. Bidder Qualifications

가. 입찰공고일 현재 대상 물품의 제조·공급 또는 납품 수행이 가능한 사업자이어야 합니다.
A. As of the bid notice date, the bidder must be a business entity capable of manufacturing, supplying, or delivering the subject goods.

나. 입찰대상 물품을 직접 제조·공급하거나, 제조자 또는 공급자로부터 정당한 공급권한을 부여받은 자이어야 합니다.
B. The bidder must directly manufacture or supply the subject goods, or must have been duly authorized by the manufacturer or supplier to supply the goods.

다. 국외소재 업체는 조달청(나라장터) 등록 여부와 관계없이직접입찰 또는 국제우편을 통하여 입찰에 참가할 수 있으며, 입찰서 및 제출서류에는 대표자 또는 정당한 권한을 위임받은 자의 서명이 있어야 합니다. 조달청 등록번호 등 조달청 시스템 관련 기재사항은 해당하는 경우에만 기재합니다.
C. Overseas companies may participate by direct submission or international mail regardless of registration with the PPS (KONEPS); the bid documents and submissions must be signed by the representative or a duly authorized signatory. PPS-related entries, such as the PPS registration number, shall be completed only where applicable.

라. 허위서류 제출, 담합, 부정한 청탁 등 공정한 입찰을 저해한 사실이 확인된 업체는 입찰참가 제한, 입찰무효, 낙찰취소 또는 계약해제·해지 등의 불이익을 받을 수 있습니다.
D. A company found to have impaired fair bidding by submitting false documents, collusion, improper solicitation, or similar conduct may be subject to disadvantages such as restriction from bidding, bid invalidation, cancellation of award, or contract cancellation/termination.

마. 제출서류의 내용이 사실과 다르거나 허위로 판명될 경우 발주기관은 입찰무효, 낙찰취소 또는 계약체결 거부 등의 조치를 할 수 있습니다.
E. If the submitted documents are found to be untrue or false, the Ordering Company may take measures such as invalidating the bid, canceling the award, or refusing to enter into the contract.

*. 입찰등록 및 제출방법
*. Bid Registration and Submission Method

가. 입찰 참가신청은 입찰등록 마감일시까지 제*항의 제출서류를 발주기관이 지정한 장소에 제출함으로써 완료됩니다.
A. Application for bid participation is completed by submitting the documents listed in Section * to the place designated by the Ordering Company by the bid registration deadline.

나. 제출방법은 직접 제출을 원칙으로 하며, 국외소재 입찰자에 한하여 국제우편 제출을 허용합니다.

B. As a general rule, documents shall be submitted directly. International mail submission is permitted only for bidders located overseas.

다. 우편 제출은 입찰등록 마감일시까지 발주기관에 도착한 경우에 한하여 유효합니다.

C. Submission by mail is valid only if the documents arrive at the Ordering Company by the bid registration deadline.

라. 우편 제출 시에는 규격입찰서류와 가격입찰서류를 각각 구분하여 제출하여야 하며, 가격입찰서류는 “가격입찰서류 재중/Price Bid Documents Enclosed”이라고 표시한 별도 봉투에 밀봉하여야 합니다. 해당 가격입찰서류 봉투는 입찰서류 전체를 담은 외부 봉투 안에 함께 넣어 제출합니다.
D. For submission by mail, technical bid documents and price bid documents shall be separately prepared. The price bid documents shall be sealed in a separate envelope marked “가격입찰서류 재중/Price Bid Documents Enclosed.” The sealed price bid envelope shall be enclosed together with the other bid documents in the outer submission envelope.

마. 본 입찰에서는입찰보증금 및 입찰보증금 지급각서를 요구하지 않습니다. 다만, 계약체결·이행에 필요한 보증은 계약서에서 정할 수 있습니다.
E. For this bid,bid security and a bid security payment undertaking are not required. However, any guarantee necessary for contract execution or performance may be provided in the contract.

*. 제출서류
*. Submission of Bid and Required Documents

가. 제출서류는 「외자입찰서 부속서류(ForeignAttach)」에 포함된 양식을 기준으로 작성·제출하며, 아래 목록 중 해당 서류를 제출합니다.

A. Required documents shall be prepared and submitted based on the forms included in the Attachments to Foreign Bid Documents (ForeignAttach), and the applicable documents listed below shall be submitted

나. 「외자입찰서 부속서류(ForeignAttach)」의 양식명 또는 세부문구 중 조달청·PPS 명칭 등 본 입찰과 맞지 않는 표현은 본 공고문 및 발주기관 안내에 맞게 해석·적용합니다.

B. If any form name or detailed wording in the Attachments to Foreign Bid Documents (ForeignAttach), including references to PPS or public procurement agencies, is inconsistent with this bid, it shall be interpreted and applied in accordance with this Bid Invitation and the Ordering Company’s instructions.

다. 한국어본과 영문본이 함께 제출된 경우 그 내용이 서로 다를 때에는 한국어본을 우선합니다. 다만, 국외업체의 사업자 확인자료, 공급권한 증빙, 카탈로그 등 원문서류는 영문 제출을 허용합니다.
C. If both Korean and English versions are submitted and there is any discrepancy between them, the Korean version shall prevail. However, original documents of overseas companies, such as business existence documents, authorization evidence, and catalogs, may be submitted in English.

*. 입찰금액, 통화 및 인도조건
*. Bid Price, Currency, and Delivery Terms

가. 외국산 물품의 입찰금액은 미국통화(USD) 또는 생산·공급국 통화 등 외국통화로 견적하여야 하며, 국내산 또는 국내공급 물품은 부가가치세를 포함한 한국통화(KRW)로 견적합니다.
A. The bid price for foreign-sourced goods shall be quoted in a foreign currency such as U.S. dollars (USD) or the currency of the country of production/supply. Domestically produced or supplied goods shall be quoted in Korean won (KRW) including VAT.

나. 견적서 또는 가격입찰서에는 품목, 수량, 통화, 인도조건, 운송·보험·설치·시운전·교육·보증 포함 여부 및 기타 부대비용을 구분하여 명확히 기재하여야 합니다.

B. The quotation or price bid shall clearly state the item, quantity, currency, delivery terms, whether transportation, insurance, installation, trial operation, training, and warranty are included, and any other incidental costs.

다. 인도조건은 견적서 및 계약서에서 확정하되, 본 공고에 따른 거래조건은 Incoterms **을 적용합니다.

C. Delivery terms shall be finalized in the quotation and contract, and Incoterms ** shall apply to the trade terms under this notice.

라. 외화 입찰가격 비교·평가가 필요한 경우 가격입찰일 또는 개찰일 당일 최초 고시 매매기준율을 적용하여 원화로 환산할 수 있습니다.
D. If comparison or evaluation of foreign-currency bid prices is necessary, the prices may be converted into KRW by applying the first announced basic exchange rate on the price bid date or bid opening date.

*. 납품, 검사, 대금지급 및 하자보증
*. Delivery, Inspection, Payment, and Warranty

가. 국외 공급물품은 계약체결 또는 신용장 개설 후 *일 이내 선적하고, 국내 반입 후 발주기관이 지정한 장소에 납품, 설치 및 시운전을 완료하여야 합니다. 세부 납품기한은 계약서에서 확정합니다.
A. Foreign-supplied goods shall be shipped within ninety (*) days after contract execution or opening of a letter of credit, and delivery to the place designated by the Ordering Company, installation, and trial operation shall be completed after import into Korea. Detailed delivery deadlines shall be finalized in the contract.

나.납품장소(최종도착지)는 서울시 낙성대로 *, *층 메테오바이오텍 또는 발주기관이 지정하는 연구실로 합니다.

B. The delivery place (final destination) shall be Meteobiotech, *F, * Nakseongdae-ro, Seoul, Republic of Korea, or a laboratory designated by the Ordering Company.

다. 납품·설치 후 발주기관의 검수 및 성능확인 결과 적합한 경우 납품이 완료된 것으로 봅니다. 필요한 경우 제조자 검사성적서, 인증서, 설치·운전 확인서 등을 제출하여야 합니다.

C. Delivery shall be deemed completed if the Ordering Company confirms, after delivery and installation, that the goods pass inspection and performance verification. Manufacturer test reports, certificates, installation and operation verification documents, or similar documents shall be submitted if required.

라. 대금지급조건은 선적 후 지급, 설치·시운전 완료 후 지급, 선금·잔금 분할지급, 신용장 조건 등 중 계약체결 시 확정합니다.

D. Payment terms shall be finalized at contract execution from among payment after shipment, payment after completion of installation and trial operation, split payment of advance and balance, letter of credit terms, or other applicable terms.

마. 하자담보책임기간은 검수완료일 또는 설치·시운전 완료일로부터 *개월을 원칙으로 하되, 세부사항은 구매규격서 및 계약서에서 정합니다. 하자보수보증금은 원칙적으로 요구하지 않되, 필요 시 계약서에서 별도로 정할 수 있습니다.

E. The warranty period shall generally be twelve (*) months from the date of completion of acceptance inspection or completion of installation and trial operation, with details specified in the purchase specifications and contract. Warranty security shall generally not be required, but may be separately provided in the contract if necessary.

바. 선적·인도·설치가 지체되는 경우 발주기관은 계약서 및 적용 기준에 따라 지체상금 또는 지연배상금을 부과할 수 있으며, 지체상금이 계약보증금액에 이르는 경우 계약을 해제 또는 해지할 수 있습니다.
F. If shipment, delivery, or installation is delayed, the Ordering Company may impose liquidated damages or delay compensation in accordance with the contract and applicable standards, and may cancel or terminate the contract if the liquidated damages reach the contract security amount.

*. 규격검토, 가격입찰
*. Specification Review and Price Bid

가. 발주기관은 입찰등록 마감 후 제출된 기술(규격)입찰서, 상세규격서, 카탈로그 및 증빙자료 등을 검토하여 규격 적격 여부를 판단합니다.

A. After the bid registration deadline, the Ordering Company shall review the submitted technical/specification bid, detailed specifications, catalogs, and supporting documents to determine technical qualification.

나. 규격검토 결과 적격으로 판정된 업체에 한하여 가격입찰서류 개봉 일시를 별도 통보합니다.
B. The date and time of the price bid opening will be separately notified only to bidders determined to be technically qualified after specification review.

다. 개찰 결과 추정가격을 초과한 입찰은 낙찰대상에서 제외하며, 추정가격 이하 최저가격 입찰자를 낙찰예정자로 선정합니다.
C. As a result of bid opening, any bid exceeding the estimated price shall be excluded from award consideration, and the bidder with the lowest price at or below the estimated price shall be selected as the prospective successful bidder.

라. 낙찰예정자는 발주기관이 요청하는 기한 내 계약체결에 필요한 서류를 제출하여야 하며, 미제출 또는 부적합 판정 시 낙찰이 취소될 수 있습니다.
D. The prospective successful bidder must submit the documents required for contract execution within the period requested by the Ordering Company. Failure to submit such documents or a finding of non-compliance may result in cancellation of the award.

*. 입찰의 무효청렴·공정입찰 및 기타 유의사항
*. Invalid Bids, Integrity/Fair Bidding, and Other Notes

가. 입찰참가자격 미충족, 필수 제출서류 미제출, 규격검토 불가, 입찰조건 위반, 동일인의 중복입찰, 대리권 또는 서명권한 흠결, 담합·허위서류 제출 등 공정한 입찰을 저해하는 사유가 있는 경우 해당 입찰은 무효로 할 수 있습니다.

A. A bid may be deemed invalid if there is any reason that impairs a fair bid, including lack of bid qualifications, failure to submit required documents, inability to conduct specification review, violation of bid conditions, duplicate bidding by the same person, lack of agency or signing authority, collusion, or submission of false documents.

나. 입찰자는 입찰, 낙찰, 계약체결 및 계약이행 과정에서 금품·향응 제공, 입찰가격의 사전 협의, 담합, 알선·청탁 등 공정한 경쟁을 방해하는 행위를 하여서는 아니 됩니다.
B. A bidder shall not engage in any conduct that interferes with fair competition in the course of bidding, award, contract execution, or contract performance, including provision of money or entertainment, prior agreement on bid prices, collusion, mediation, or improper solicitation.

다. 제출된 서류는 반환하지 아니하며, 제출서류의 내용이 불명확하거나 사실과 다른 경우 발주기관은 보완요구, 부적합 처리 또는 입찰무효 처리를 할 수 있습니다.
C. Submitted documents will not be returned. If the content of submitted documents is unclear or untrue, the Ordering Company may request supplementation, determine non-compliance, or invalidate the bid.

라. 계약상대자는 해외공급자, 제조자, 운송업자 등과의 관계에서 발생하는 공급, 통관, 선적, 납품 지연 및 관련 비용에 대하여 책임을 집니다.

D. The contractor shall be responsible for supply, customs clearance, shipment, delivery delays, and related costs arising in relation to overseas suppliers, manufacturers, carriers, and other parties.

마. 입찰무효, 청렴·공정입찰, 제출서류 보완, 준거법 및 분쟁해결 등 세부사항은 「외자구매 입찰유의서」에 따르며, 제출양식은 「외자입찰서 부속서류(ForeignAttach)」를 사용합니다.

E. Detailed matters regarding invalid bids, integrity and fair bidding, supplementation of documents, governing law, dispute resolution, and related matters shall be governed by the General Instructions to Bidders and Forms.
